Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TermLink software, websites, and related services (collectively, the “Service”) provided by TermLink (“we”, “us”, or “our”). By using the Service, you agree to these Terms.

1. The Service

TermLink enables you to connect an iOS client to a Mac Agent to view and interact with tmux sessions on your Mac over an encrypted peer-to-peer connection. The Mac Agent is a command-line tool; the iOS app is the mobile client. Features may vary between free and paid tiers.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts and subscriptions

TermLink Pro and other paid features, when available, are purchased through the Apple App Store. Your purchase is subject to Apple’s terms and payment policies. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period through your Apple ID subscription settings.

Refund requests for App Store purchases must be directed to Apple in accordance with Apple’s policies.

4. Acceptable use

You agree not to:

  • Use the Service in violation of any applicable law or regulation
  • Access systems or tmux sessions without authorization
  • Interfere with or disrupt the Service, networks, or other users
  • Reverse engineer, decompile, or attempt to extract source code except where permitted by law
  • Use the Service to distribute malware or conduct unauthorized surveillance
  • Resell or sublicense the Service without our written permission

You are responsible for securing your Mac, tmux sessions, pairing tokens, and trusted device list. Only pair devices you trust.

5. Your content and data

You retain ownership of content displayed in your terminal sessions. TermLink does not claim ownership of your shell output, files, or commands. You grant us only the limited rights needed to operate the Service (for example, processing support emails you send us).

6. Intellectual property

The Service, including software, branding, documentation, and website content, is owned by TermLink and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as necessary to use the Service as intended.

7. Third-party services

The Service may interoperate with third-party technologies (including Apple, connectivity and relay providers, and tmux). We are not responsible for third-party products or services. Your use of them is subject to their respective terms.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or suitable for every environment. Remote access depends on your devices, networks, and configuration. You use the Service at your own risk.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERMLINK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

10. Indemnification

You agree to indemnify and hold harmless TermLink from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Upon termination, provisions that by their nature should survive will remain in effect.

12. Changes

We may modify these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory local law applies. Disputes will be resolved in the courts located in Delaware, unless applicable law requires otherwise.
